6.3.4     Constructional noise abatement measures at the source of emission

Installations subject to licensing are checked within the required licensing procedure whether they use the best available noise abatement measures. Installations not subject to licensing are checked within a normal building procedure.

In case there are doubts about the environmental impacts of a building project during the processing of a building application, an expert opinion is to clarify the situation. This will finally be the cheapest solution for the potential emitter of excessive noise as remedial measures as a consequence of complaints and subsequent orders are often very costly and also accompanied by a loss of confidence from a sceptical neighbourhood.

The accumulation of noise complaints in the summertime shows that not only the open windows of the appellants lead to an intensified perception of noise. Most firms possess a heating system but many have no sufficient aeration possibilities or air-conditioning at the workplaces during the summer heat and as a consequence disturbing industrial noise propagates through open windows, doors and gates.
